私が思うに・・・
この分の構造としては、
「to communal ownership of land」を言い換えて具体的に説明しているのが
「to what had been a pre-Columbian form of ownership respected by the Spaniards」
だと思います。つまり「what...」は「ownership of land that...」でしょう。
(E) land that had been a pre-Columbian form of ownership respected by the Spaniards
だと、land=form of ownershipとなってしまうので、違うのではないでしょうか？
